Our company, Prescribe Smart Inc. (subsequently referred to as “Prescribe Smart”, “we”, “us” or “our”, below), owns and operates the website located at Prescribesmart.ca and Prescribesmart.com (the “Website”) and the application Prescribe Smart (the “App”) available to download on Google Play and the Apple App Store. We respect and are committed to protecting your privacy, and we support a general policy of openness about how we collect, use and disclose your personal information.

This Privacy & Security Policy (the “Policy”) informs you how Prescribe Smart collects, uses and discloses the personal information that you provide to us through use of our Website and App and creating an account to use our services. By visiting the Website & App, creating an account to use our services or otherwise using any Prescribe Smart online service, you consent to the collection, use and disclosure of your personal information in accordance with this Policy.

We recommend that you take the time to read this Policy so that you understand how we handle and process information, including personal information. As we develop and expand our services, this Policy may also change. We will include a "last amended" date on the Policy as displayed on the Website and App. We strongly encourage you to refer back to the Policy periodically.

This Policy also explains how you can contact us if you have a question about our privacy practices, want to change or update your personal information or change your preferences concerning our use and disclosure of your personal information.

For the purpose of this Policy, "personal information" means information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee or volunteer of an organization (“excluded information”). Prescribe Smart will not collect, use or disclose your personal information in a way that is incompatible with this Policy. Prescribe Smart will not collect any excluded information.

1. How We Collect and Use Personal Information

Account Creation and Service Delivery

When you sign up for an account with Prescribe Smart, we ask for your full name, email address, address, and a password. We use this information to process and maintain your account request or facilitate the provision of other services you request from us.

For example, we use your email address to answer inquiries that you send to us, and to communicate with you when necessary concerning the administration of your account and any feedback you may provide. As these functions are necessary to the proper administration of your account and our related services, we do not offer an opt-out from providing your email address for such communications.

 

Use of Personal Information

We will only collect personal information in order to:

  • verify identity;
  • perform the services in relation to the Website&App;
  • open and manage an account;
  • ensure you receive a high standard of service;
  • further develop our services;
  • meet regulatory requirements; or
  • any other legal reasons as apply to your use of the Website and App.
  • Personalize the services, including advertising

 

Email and Profession Information for Marketing Purposes

As a Prescribe Smart user, you may receive email and/or push or in-app notifications from us that inform you about new functionality or new updates/formulary changes or other initiatives affiliated with Prescribe Smart. You may opt-out of receiving such communications by contacting us at admin@prescribesmart.com . If you do not opt-out, we will use your personal information for these purposes.

 

We may personalize the Services, including the advertising you see within the Prescribe Smart App and Website, on third party websites and in our email communications, based on information included in your registration. For example, a user who Prescribe Smart believes is a cardiologist or who has browsed cardiology content with the Prescribe Smart platform may be served an advertisement promoting a particular cardiac product within the Prescribe Smart platform, on third party websites and/or within an email that a user who Prescribe Smart believes is a neurologist or has not browsed cardiology content will not see. We partner with third parties to manage and conduct our advertising activities including advertising on our websites and App and on third party websites. These third parties may use cookies and other tracking technologies to deliver this advertising based on your activities and interests as inferred from your use of the Services and other information they have about you. Also, advertisers may use their own cookies and other tracking technologies in the advertisements served to you through the Services, some of which may enable the advertiser to obtain personal information that can be used to specifically identify you, including the fact that you saw the advertisement, to the extent that you have separately provided consent to the advertiser or to the third party providing the tracking technology. Some advertisers use companies other than Prescribe Smart to serve their advertisements on their behalf and to monitor users' responses to these advertisements through the use of cookies and other tracking technologies. While Prescribe Smart generally permits the use of third party tracking technologies based on an understanding that they comply with the Prescribe Smart Advertising Policy, we do not have control over these third parties' use of cookies and other tracking technologies or how they manage the information they gather through them and Prescribe Smart may be unable to verify compliance with the Prescribe Smart Advertising Policy.

 

2. Updating Your Personal Information

You may update or change your personal information anytime by clicking on your account from the menu on the Website and App.

 

3. Knowledge and Consent

Prescribe Smart collects personal information about you only when you voluntarily provide it. Typically, we will seek consent for the use or disclosure of your personal information at the time of collection. In certain circumstances, consent may be sought after the information has been collected but before use (for example, when we want to use information for a purpose not previously identified).

The form of consent that we seek—including whether it is express or implied—will largely depend on the sensitivity of the personal information and the reasonable expectations of the individual in the circumstances. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. If you wish to withdraw your consent at any time, please contact us at admin@prescribesmart.com . We will inform you of the implications of withdrawing consent. We will not, as a condition of the supply of a product or service, require you to consent to the collection, use or disclosure of information beyond that reasonably required to fulfill the explicitly specified and legitimate purposes for which the information is being provided.

 

4. When We Disclose Your Personal Information

Prescribe Smart may also disclose personal information about its members to a third party if (a) a law, regulation, search warrant, subpoena or court order legally requires or authorizes us to do so; or (b) necessary to enforce and protect the terms and conditions of our agreement(s) with you or the Terms of Use applicable to your use of the Website and App.

 

Prescribe Smart also reserves the right to disclose and/or transfer personal information to a third party in the event of a proposed or actual purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal or financing of all or any portion of Prescribe Smart or of any of the business or assets or shares of Prescribe Smart, provided that the third party represents that it will continue to use the information for the purposes set out in this Policy and in accordance with applicable privacy protection laws.

 

5. Retention of Your Personal Information

We retain your personal information for the period that you remain a user for the purposes described above, and following the termination or suspension of your account for such further periods as required by applicable laws or limitation periods and as necessary to allow us to guard against fraud. In the event you decide to suspend and then reactivate your account with Prescribe Smart, you may be prompted to confirm your personal information at that time if your personal information continues to be retained by Prescribe Smart for the purposes described above.

To submit a question to us about the collection or use of your personal information, please email us at admin@prescribesmart.com and insert “Privacy Information Question” in the subject header. If requested, Prescribe Smart will provide you with a copy of your personal information in electronic form, which may include:

  • what personal information Prescribe Smart is storing;
  • where it is being stored; and
  • for what purpose we are storing it.

 

At any time, you may request that we remove your personal information from our records and we will delete your personal information within ten (10) days of such request.

 

6. How We Protect Your Personal Information

Prescribe Smart uses commercially reasonable efforts to protect your personal information from loss, unauthorized access, misuse or theft. Only Prescribe Smart staff who have a legitimate business purpose for accessing the personal information collected by Prescribe Smart are authorized to do so. Unauthorized access to or use of personal information by anyone affiliated with Prescribe Smart is prohibited and constitutes grounds for disciplinary action.

In the unlikely event that our system is breached, and your personal information has been compromised, we will notify such local authorities as may be required within seventy-two (72) hours of the breach, and will also use our best efforts to notify you, using the most current contact information that we have on file. We are not responsible for any failure to notify you based on incorrect or outdated contact information.
